Terms of service
The agreement between you and us when we make a film for you. Written to be read, not to be survived.

1. Who you are dealing with
yacht-tour.com is operated from France. “We” and “us” mean the operator of the site. “You” means the brokerage, dealer or individual ordering a film.
This is a business-to-business service. If you are buying as a consumer rather than in the course of a trade, tell us before you order, because different rules apply to you and we would rather apply them correctly.
2. What we provide
We produce listing films from photographs and information you supply or direct us to. A film is delivered as one or more standard MP4 files in the aspect ratios agreed. We are a production service, not software you license: there is no account to maintain and nothing to renew in order to keep using a film you already have.
3. Ordering and price
Prices shown on this site are for the packages described and are quoted excluding any tax that may apply to your jurisdiction. An order is formed when we confirm in writing what we will produce and at what price. Until then, nothing on this site is a binding offer.
Unless we agree otherwise in writing, payment is due before delivery. Packages of five and ten listings are paid up front and the listings may be submitted whenever suits you; they do not expire.
4. What we need from you
- Media you are entitled to use, per Media rights and usage
- Accurate specifications, because captions repeat what you give us
- Your logo and contact details, if you want them on the film
- Answers within a reasonable time when we ask a question
If a listing’s gallery is too thin or too low-resolution to produce something worth publishing, we will tell you before taking payment rather than deliver something you would not use.
5. Turnaround
Turnaround figures quoted on this site are targets based on past work, not guarantees. Most films are delivered inside a day of us having everything we need. If you have a hard deadline, tell us in advance and we will say plainly whether we can meet it.
Time does not start until we have the media and the information the film needs.
6. Revisions
Every package includes revisions to fix anything wrong with the film: a clip that misrepresents the boat, a caption with the wrong figure, a transition that does not work, a section you want cut. Tell us and we recut it.
Repeatedly redirecting a film toward a different concept after delivery is new work rather than a revision, and we will say so and quote for it before doing anything.
7. Refunds
If we cannot deliver a film you can use, you get your money back. No argument, no restocking fee. That applies when the output is genuinely unusable or we fail to deliver at all.
It does not apply once a film has been delivered, revised to your satisfaction and published. Unused listings in a pack are refundable pro rata at the single-listing price for the listings you did use.
8. Ownership
You keep ownership of your photographs, logos, listing copy and brand. We keep ownership of our own production methods, prompts, templates and software. On payment you receive the rights in the delivered film described in Media rights and usage.
9. Acceptable use
You may not use this service to:
- Produce a film for a boat you are not authorised to market
- Misrepresent a vessel’s condition, specification or history
- Process media you do not hold the rights to
- Produce material that is unlawful where it will be published
We may decline or stop work that falls into any of these, and will refund anything paid for work we decline to do.
10. Availability of this site
The site is provided as it is. We do not promise uninterrupted availability, and we may change, suspend or withdraw any part of it. None of that affects a film already delivered to you, which is a file you hold rather than a service you depend on us to keep running.
11. Liability
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Subject to that, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for lost profit, lost sales, lost or delayed transactions, loss of goodwill, or any indirect or consequential loss.
In particular, we are not responsible for the commercial outcome of a listing. A film is a marketing asset; whether a boat sells depends on price, condition, market and brokerage, none of which we control.
12. Your warranty and indemnity
You warrant that you hold the rights to everything you send us and that the information you give us about a vessel is accurate. You will cover us against claims, losses and reasonable costs arising from a breach of that warranty.
13. Confidentiality
Listings you send us before they go public stay private. We will not discuss an unpublished listing, a price or a client relationship with anyone, and we will not show a film publicly if you have asked us not to.
14. Ending the relationship
Either of us may stop at any time. If you cancel an order before we start production, you are refunded in full. If you cancel during production, we will refund the part not yet produced. If you breach the acceptable use section, we may stop immediately.
15. Changes to these terms
We may update these terms. The version that applies to your order is the one published when the order was confirmed. Material changes are reflected in the date at the top of this page.
16. Governing law
These terms are governed by French law, and the courts of France have jurisdiction over any dispute. Before anyone reaches a court, write to hello@yacht-tour.com. Almost everything is solvable that way.
